The Council of Mayfield Village met in Caucus Session on Monday, November 1, 2021. Council President Schutt stated, good evening, everyone and welcome to the Mayfield Village, Ohio Council Caucus meeting. It is Monday, November 1, 2021 at 7:00 p.m.

- Ordinance No. 2021-14, entitled, “An Ordinance enacting Chapter 1175 Beta Core Commercial District Overlay and revising the zone map of Mayfield Village so as to overlay the Beta Core Commercial District over certain properties located on Beta Drive in Mayfield Village.” Introduced by Mayor Bodnar. Council President Schutt asked, discussion?
Mr. Marquart stated, yes, Council President. In drafting the new zoning chapter, we thought there were some benefits to including some drive-thru language. However, after the discussion at your last meeting, I met with the Mayor and Ms. Wolgamuth to discuss the language. We thought it would be preferable to remove the drive-thru language altogether rather than risk losing what we feel are the benefits of the rest of the chapter which would allow businesses to sort of expand rather than look elsewhere. With that, I think we are looking for a motion to amend at Second Read. Ms. Weber, if you don’t mind filling in on the process for that, I would appreciate that.
Ms. Weber stated, absolutely. The way our ordinances are set up is that Council can amend any ordinance or resolution at any time during the reads. However, prior to the Second Read, you don’t have to restart and go back and do the First Read again. We will be able to amend it and it would start right at that Second Read at Council’s Regular Meeting.

- Volunteer Firefighters’ Dependent’s Fund Board
- Designation of 2 members of the legislative authority
Pursuant to Chapter 146 of the Ohio Revised Code, a Volunteer Firefighters’ Dependents Fund Board was established by way of Mayfield Village Ordinance 2014-21 in order to provide benefits to volunteer firefighters and their dependents and to part-time firefighters injured in the line of duty who are not under the OPERS system. The continuance of the Board is also necessary for the purpose of applying for and receiving grants.
The Board consists of 5 members. Two members must be elected by the Fire Department. They can be full-time, part-time or retired firefighters. On November 3rd, I forwarded a memo requesting nominations to the Fire Department to be posted in a conspicuous place. Voting commenced on the 3rd and will conclude on November 10th. Chief Carcioppolo will be providing me with the sealed envelopes containing the nominations.
Two members of the Board are to be elected by Council for a one-year term at the November 15th Regular Meeting of Council. Once the appointments from the Fire Department and Council are made, the fifth member, an elector of the political subdivision. shall be elected by the members of the Board at a meeting to be held on or before December 31st pursuant to the instructions of the State Fire Marshal. During that meeting, elections of a Chairperson and Secretary and the 5th Board member are held. Previous meeting minutes are reviewed and approved. Financials are also reviewed and the payment of any assessment charges incurred during the term of the Board is approved.

ADMINISTRATION:

I just have a couple of building updates for you. I wanted to let you know that the second replacement boiler was installed last week here at the Civic Center. We also had a new fire panel put in last week. We have a pre-construction meeting with Rycon Construction on the restrooms this Wednesday. At that meeting, we should get the construction schedule. I also wanted to mention that there is a Garden Club Craft Show this Saturday from 9-4 at the Community Room. That’s all I have. Thank you.

FIRE DEPARTMENT:

- Station Alerting
Thank you, Council President. We have on here upgrading our station alerting system. This is to keep up with the Regional Dispatch Centers. There is a quote for $17,925. We have $44,000 budgeted for this capital purchase. It’s been in the works for a couple of years. They were running a pilot to test the system to make sure it could function in the capacity it needs to. Chagrin Valley Dispatch is who is running the show right now for approximately 40 of the departments in Cuyahoga County. This will give our dispatch center the ability to tone out all our mutual aid companies with the click of a button instead of having to call all of the cities individually. It also gives all those communities that are run through the different centers the same ability to tone us out through the same system. We have a conference call tomorrow to discuss some of this. It might be a little bit less money because we do have our own system that our dispatch uses to tone us out. They just don’t have the ability to tone out other cities without physically picking up the phone and calling them. It saves time and response and it’s keeping up with the rest of the area. FINANCE DEPARTMENT:

I have a couple of items. A month or two ago, Council approved an expenditure to reimburse Progressive for our portion of the improvements to their main road access to Campus I. That project is completed. We received our invoice. It was a differential of $358.88 so we will have to put that on Council’s agenda for this month to get approval for that additional amount before we can reimburse them.
The second item is also regarding Progressive. At Caucus last month, I reported on the income tax situation that Progressive was now starting to withhold based upon where the employees are actually working which is their homes. At that time, we were starting to notice a decrease of about $525,000 a month. Based upon their last two payrolls, that is about $630,000 a month but the past two payrolls have kind of leveled off and they have been inconsistent, so hopefully that’s the last of the adjustments we will see and then we continue to press forward and look at the return to the office date of January 3rd for their campuses. Sewer District request for Right of Entry on Village property at Bonnieview and Beech Hill
As a late addition in your packets, there was a right-of-entry that is being requested from the Northeast Ohio Regional Sewer District. This is to perform certain work that is over on Bonnieview Road. There is a large pipe that is no longer in use that needs to be removed as it is creating some sinkhole issues. This is not going to take very long, but they will need to come on to Village property in order to do that work, so this right of entry agreement allows the Sewer District to come on to the Village property as well as the right of way in order to remove the pipe. Additionally, the neighboring property owner has been in contact with the Sewer District directly regarding any work that would need to be done on their property and they are in agreement with the Sewer District. We would be requesting Council approval to enter into that right-of-way agreement.

SERVICE DEPARTMENT:

- Purchase of new zero turn riding mower (Marshall Power Equipment - $15,815)
I am seeking authorization to purchase a new eX-mark 60-inch Lazer 2 series mower. It’s going to be replacing our 2013 model. The reason we are replacing it is the model has 2500 hours on it. It started to burn oil and is showing signs of mechanical problems. Any questions?

- Tree Pruning in Aintree Park neighborhood (Davey Tree Experts - $19,000)
We are looking to do some tree work by Heinen’s over here by Raleigh, Derby, Beecher’s Brook, Chase, Foxboro, Northboro, Hunt Circle and Aintree Park Drive. We received three quotes, one from Davey Tree for $19,000, one from VanCurren for $49,400 and one from Veneer Tree Service for $118,000. Obviously, Davey Tree came in at the lowest. The scope of the work is going to be to trim the trees 20 feet up off the road and along the entire circumference of the trunk and to prune out any dead wood or any branches that are a hazard. I think the reason Davey came in so low is because they are a very large company and have worked here before. I am happy with their work. Any questions?

- Repeal of Chapter 975 – Tool Lending Program
I am looking to repeal our Tool Lending Program, Chapter 975 of the Codified Ordinances. Over the years we have seen a drop in the use of this program. This year we have had only 17 rentals. Five of those are repeat customers. Eleven of those were for chainsaws and hedge trimmers. I put in there the description that maintaining this to a high standard and checking them out when they are leaving and coming back in, we don’t know what these residents are doing with them when they go out. I just think it’s a big liability to be renting out this kind of equipment any more. Especially with Home Depot and all these other places around that are out there. There’s a lot of things on the list for the tool rental that we don’t even have in our stock anymore because it’s so old. It’s from 1983. That’s why I am looking to repeal this. Any questions?
