The Planning and Zoning Commission met in Special Meeting session on Mon, Sept 17, 2018 at 7:30 p.m. at the Mayfield Village Civic Center, Civic Hall. Chairman Syracuse presided. 

Roll Call

Present: Mr. Vetus Syracuse (Chairman), Mr. Paul Fikaris (Chairman Pro Tem), Dr. Stephan Parker, Mr. Jim Farmer, and Mr. Jim Kless

Also Present: Mr. Anthony Coyne (Law Director), Mr. Tom Cappello (Village Engineer), Mr. John Marrelli (Building Commissioner), and Ms. Deborah Garbo (Commission Secretary)

Absent: Mayor Bodnar and Dr. Sue McGrath (Leave of absence thru 2018)

CONSIDERATION OF MEETING MINUTES: Sept 4, 2018

Mr. Kless, seconded by Mr. Fikaris made a motion to approve the minutes of Sept 4, 2018.

OPEN PORTION:

Chairman Syracuse called the meeting to order. This is a Special meeting of the Mayfield Village Planning & Zoning Commission Mon, Sept 17, 2018. We’re here to re-take a vote from our regular meeting called on Sept 4th. The proposal before us is the same that we had on Sept 4th, a Conditional Use Permit for Tuff Shed, Inc 600 Beta Dr. There were three proposals for the Conditional Use Permit;

  1. Outdoor Storage Display
  2. Retail Sales
  3. Signage Rear of Building

I’d like to take these as separate items tonight. Mr. Coyne, if you could explain why we had to reconvene.

Mr. Coyne said absolutely Mr. Chairman. The meeting that took place on Sept 4th was conducted from a standpoint of presentation properly and so forth. However, all of the participants and members of the Board that were present did not all participate in the vote. The Charter provides who the members are of the Planning Commission. The Charter also provides that the Planning Commission for an affirmative vote requires 4 votes from the members of the Planning Commission. At that meeting when you look at the roll call, those in attendance were Mr. Syracuse, Mr. Fikaris, Dr. Parker, Mr. Farmer and Mr. Kless. During the votes that were taken, one member did not vote and the alternate Council member did. This was just a mistake. When I looked at the Charter again, I think it’s appropriate that we come back and re-vote, we don’t need to repeat the presentation because Dr. Parker was present and saw the presentation that was done for Tuff Shed, Inc. The three motions that were taken, one involved the outdoor storage display, second involved retail sales percentages, third was the signage on the rear of the building. The retail sales vote was a unanimous vote so I don’t think you have to address that. The other two matters were as such that you did not have the members of 4 of the members of the Commission to vote so I suggest that those items be re-voted on.

Chairman Syracuse thanked Mr. Coyne. So we’re only going to take a vote on the outdoor storage display and the signage at the rear of the building, is that correct?

Mr. Coyne replied, that’s correct.

Chairman Syracuse asked the representative for Tuff Shed if there was anything he would like to add from the last meeting.

Jeff Kennedy, Director of Transactions with Weston replied no. If there are any questions for me I’d be happy to answer them, but otherwise it seems like you’re ready to take the vote.

Chairman Syracuse asked, does anyone else have any questions?

There were none.

DECISION:

a) Outdoor Storage Display

Dr. Parker, seconded by Mr. Farmer made a motion to approve the Conditional Use Permit for Outdoor Storage Display for Tuff Shed, Inc at 600 Beta Dr. as noted:

  • No displays permitted along the rear of the property facing the highway.
  • Maximum of up to 6 (six) shed displays permitted along the side of building as proposed.
  • Outdoor shed displays must be locked overnight at close of the business day.

Motion Carried as Noted. Recommendation to Council.

c) Signage Rear of Building

Mr. Kless, seconded by Mr. Fikaris made a motion to approve the Conditional Use Permit for Signage at the Rear of Building for Tuff Shed, Inc at 600 Beta Dr. as proposed.
