AN EMERGENCY ORDINANCE
AUTHORIZING AND DIRECTING THE MAYOR AND PRESIDENT OF COUNCIL
TO ENTER INTO A PURCHASE AGREEMENT
TO PURCHASE THE REAL ESTATE
LOCATED AT 586 S.O.M. CENTER ROAD
WHEREAS, the real estate located at 586 S.O.M. Center Road, Mayfield Village, Ohio sits in proximity of two (2) separate retention basins, the Palermo Basin and Wiley Basin; and
WHEREAS, the Village intends to purchase the real estate in order to accommodate the expansion of existing retention basin areas; and
WHEREAS, the current owners of that property, Keyan Nasseri and Nadette Nasseri, are in agreement to sell the Village their real estate; and
WHEREAS, Council deems it necessary and in the best interest to the health, safety and welfare of all Village residents to enter into a Purchase Agreement with Keyan Nasseri and Nadette Nasseri.
NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Mayfield, County of Cuyahoga, State of Ohio:
SECTION 1. The Council of Mayfield Village, Ohio hereby authorizes and directs the Mayor and President of Council to enter into a Purchase Agreement with Keyan Nasseri and Nadette Nasseri as set forth in the document attached hereto and incorporated herein by reference as Exhibit “A”.
SECTION 2. The Council finds and determines that all formal actions of the Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code.
SECTION 3. This Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the health, safety and welfare of the residents of Mayfield Village. It shall, therefore, take effect immediately upon passage by the affirmative vote of not less than five (5) members elected to Council and approval by the Mayor or otherwise at the earliest time allowed by law.
