AN EMERGENCY ORDINANCE
AUTHORIZING THE MAYOR TO ENTER INTO
A NATURAL GAS SALES AGREEMENT WITH
NEXTERA ENERGY SERVICES Ohio, LLC
IN ORDER TO ENROLL IN A GAS ENDORSEMENT PROGRAM

WHEREAS, NextEra Energy Services Ohio, LLC, in coordination with the Northeast Ohio Public Energy Council (“NOPEC”) has created a gas endorsement program for certain accounts that no longer qualify for NOPEC’s gas aggregation rate; and

WHEREAS,  Mayfield Village currently has five (5) gas accounts that would qualify for the gas endorsement program being offered by NextEra Energy Services Ohio, LLC; and

WHEREAS, it is the desire of Mayfield Village Council to enter into the gas endorsement program with NextEra Energy Services Ohio, LLC to allow the Village to obtain the benefit of a lower rate(s).

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO THAT:

SECTION 1. Council hereby authorizes the Mayor to enter into a Natural Gas Sales Agreement to enroll the five (5) gas accounts that would qualify for the gas endorsement program offered by NextEra Energy Services Ohio, LLC, as set forth in the Agreement attached and incorporated by reference as Exhibit “A.”

SECTION 2. Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code.

SECTION 3.   This Ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio.  It shall, therefore, take effect immediately upon the passage by the affirmative vote of not less than five (5) members elected to Council and approval by the Mayor or otherwise at the earliest time allowed by law.
