Resolution 2015-20

AN RESOLUTION AUTHORIZING THE
MAYOR TO ENTER INTO A CONTINUANCE OF
THE MEMORANDUM OF UNDERSTANDING
WITH THE CHAGRIN RIVER WATERSHED PARTNERS, INC.
FOR PROVIDING ASSISTANCE TO MAYFIELD VILLAGE
RELATIVE TO FULFILLING OBLIGATIONS UNDER ITS
STORMWATER MANAGEMENT PROGRAM

WHEREAS, Chagrin River Watershed Partners, Inc. is a non-profit corporation formed by communities in the Chagrin River watershed to assist those communities in the management of stormwater runoff and related resource management issues.

WHEREAS, Mayfield Village is a member in good standing of the Chagrin River Watershed Partners, Inc.

WHEREAS, Mayfield Village is required to obtain a permit from the Ohio Environmental Protection Agency under General National Pollution Discharge and Elimination System (NPDES) Permit No.: OHQ000003 for stormwater discharges from its MS4, as defined in the permit.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT:

SECTION 1.   Council hereby authorizes the continuance of the Memorandum of Understanding with the Chagrin River Watershed Partners, Inc. from January 1, 2015 to December 31, 2019 for providing assistance in fulfilling obligations under its stormwater management program (Exhibit A attached hereto).

SECTION 2. The Council finds and determines that all formal actions of the Council relating to the adoption of this Resolution have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code.

SECTION 3. This Resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the health, safety and welfare of the residents of Mayfield Village. It shall, therefore, take effect immediately upon passage by the affirmative vote of not less than five (5) members elected to Council and approval by the Mayor or otherwise at the earliest time allowed by law.
