AN EMERGENCY RESOLUTION
DECLARING THE NECESSITY OF RENEWING BY LEVY
A TAX IN EXCESS OF THE 10-MILL LIMITATION AND SUBMITTING
THE SAME TO THE ELECTORATE OF MAYFIELD VILLAGE, OHIO.

WHEREAS, the Council of the Village has received from the Cuyahoga County Fiscal Officer certification of the current tax valuation of the subdivision and the amount of revenue that would be produced by the 2.3-mill renewal levy in excess of the ten-mill limitation for current expense purposes pursuant to Division A of Section 5705.19 of the Revised Code; and

WHEREAS, the Council of the Village has determined that the amount of taxes which may be raised with the ten-mill limitation will be insufficient to provide an adequate amount for the necessary requirements of the Village and that it is necessary to levy a tax in excess of that limitation for the purpose of current expenses; and

WHEREAS, the Council has deemed it to be in the best interest of the municipality to renew the levy of a 2.3 mills tax for an additional period of five (5) years for the payment of current expenses.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT:

SECTION 1. It is hereby declared that the amount of taxes that may be raised by the levy of taxes within the ten-mill limitation, to wit: Section 5705.02 of the Revised Code of Ohio, by levies on the taxable property in the Village will be insufficient to provide an adequate amount for the necessary requirements of said Village and it is necessary for the purpose of providing for funds for current expenses to seek a renewal of a 2.3 mill existing tax levy.

SECTION 2. It is hereby declared necessary to seek a renewal of a 2.3 mill existing tax levy, in excess of the ten-mill limitation for the benefit of Mayfield Village for the purpose of paying current expenses as authorized in Division A of Section 5705.19 of the Revised Code at a rate not to exceed 2.3 mills for each $1.00 of valuation, which amounts to Twenty-Three Cents ($.23) for each One Hundred Dollars ($100.00) of valuation, for a period of five (5) years beginning with the tax duplicate year 2015, first due in Calendar year 2016 for placement on the November 4, 2014 ballot.

SECTION 3.  That the renewal tax levy shall be effective and shall be placed on the tax list and duplicate for each of the tax duplicate years of 2015, 2016, 2017, 2018 and 2019, if a majority of those voting on the question vote in favor thereof.

SECTION 4.  The Clerk of Council is hereby authorized and directed to certify a copy of this Resolution to the Cuyahoga County Board of Elections as provided by law no later than August 6th, 2014, and to notify the Board of Elections to cause notice of said election on the question of levying said tax to be given as required by law.

SECTION 5.  The Cuyahoga County Fiscal Officer has certified to the Village pursuant to Section 5705.03 of the Ohio Revised Code, the current total tax valuation of the Village and the dollar amount of revenue that would be generated by the renewal of 2.3 mill of an existing levy of a five (5) year period of time beginning with the 2015 tax list and duplicate.

SECTION 6. The Board of Elections is hereby directed to certify the result of said election, immediately after the canvass of said Board of Elections, to the taxing authority of said County in order to permit the renewal of such levy, if approved by the electorate, on the 2015 tax  duplicates for the electors of the Village.

SECTION 7. The form of the ballot to be used at such election shall be substantially as follows:

“A RENEWAL OF A TAX FOR THE BENEFIT OF MAYFIELD VILLAGE FOR THE PURPOSE OF CURRENT EXPENSES AT A RATE NOT EXCEEDING 2.3 MILLS FOR EACH ONE DOLLAR OF VALUATION, WHICH AMOUNTS TO TWENTY-THREE CENTS ($.23) FOR EACH ONE HUNDRED DOLLARS OF VALUATION FOR FIVE (5) YEARS, COMMENCING IN JANUARY 2015, FIRST DUE IN CALENDAR YEAR 2016.”

SECTION 8.  The Council finds and determines that all formal actions of this Council relating to the adoption of this Resolution have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 and 5705.19 of the Ohio Revised Code.

SECTION 9.  This Resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the health, safety and welfare of the residents of Mayfield Village and in order to obtain the information necessary to submit the within proposed renewal tax levy to the Board of Election by the deadline for submission of ballot issues to be submitted to the electors of the Village at the General Election to be held on November 4, 2014.  It shall, therefore, take effect immediately upon passage by the affirmative vote of not less than five (5) members elected to Council and approval by the Mayor or otherwise at the earliest time allowed by law.
