AN EMERGENCY RESOLUTION
AUTHORIZING AND DIRECTING THE MAYOR
TO ENTER INTO AN AMENDMENT TO THE
URBAN COUNTY COOPERATION AGREEMENT
BETWEEN THE VILLAGE OF MAYFIELD AND CUYAHOGA COUNTY

WHEREAS, the Village of Mayfield and Cuyahoga County are parties to an existing Urban County Cooperation Agreement, required by the United States Department of Housing and Urban Development (HUD) to receive Community Development Block Grant funds; and

WHEREAS, HUD has notified Cuyahoga County that it must amend its existing Urban County Cooperation Agreement with each local community to make it clear that Community Development Block Grant funds cannot be traded or exchanged for other funds; and

WHEREAS, it has been deemed necessary and in the best interest of the Village to amend the Urban County Cooperation Agreement between the Village of Mayfield and Cuyahoga County to include the required language to prohibit trading or exchanging of funds.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT:

SECTION 1. The Mayor and President of Council are hereby and herein authorized and directed to enter into an amendment to the Urban County Cooperation Agreement between the Village of Mayfield and Cuyahoga County as set forth in Exhibit “A” attached hereto and incorporated herein by reference.

SECTION 2.  The Council finds and determines that all formal actions of the Council relating to the adoption of this Resolution have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code.

SECTION 3.  This Resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the health, safety and welfare of the residents of Mayfield Village.  It shall, therefore, take effect immediately upon passage by the affirmative vote of not less than five (5) members elected to Council and approval by the Mayor or otherwise at the earliest time allowed by law.
