AN EMERGENCY RESOLUTION
AUTHORIZING THE MAYOR AND PRESIDENT OF COUNCIL
TO ENTER INTO A MEMORANDUM OF UNDERSTANDING
WITH THE CUYAHOGA SOIL AND WATER CONSERVATION DISTRICT
FOR PROVIDING TECHNICAL ASSISTANCE IN
IMPLEMENTING SOIL AND WATER CONSERVATION MEASURES

WHEREAS, it is the expressed desire of Mayfield Village to enter into a Memorandum of Understanding with the Cuyahoga Soil and Water Conservation District to provide technical assistance in implementing soil and water conservation measures;

WHEREAS, this Memorandum of Understanding facilitates solutions to problems encountered by the Village as it plans for the development/redevelopment and conservation of its environment, as well as water quality improvements; and

WHEREAS, this Memorandum of Understanding describes the process for collaboration between the parties in carrying out mandated responsibilities, especially related to the Minimum Control Measures for the National Pollutant Discharge Elimination System (NPDES) for Storm Water as defined in Ohio Revised Code Section 3745-39-04(B)(1) through (6).

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT:

SECTION 1.   Council hereby authorizes the Mayor and President of Council to enter into a Memorandum of Understanding with the Cuyahoga Soil and Water Conservation District for providing technical assistance in implementing soil and water conservation measures attached hereto and incorporated herein by reference as Exhibit “A”.

SECTION 2.  The Council finds and determines that all formal actions of the Council relating to the adoption of this Resolution have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code.

SECTION 3.  This Resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the health, safety and welfare of the residents of Mayfield Village.  It shall, therefore, take effect immediately upon passage by the affirmative vote of not less than five (5) members elected to Council and approval by the Mayor or otherwise at the earliest time allowed by law.
