The Ordinance Review Committee met in regular session on Tues, Oct 11, 2016 at 5:00 p.m. at the Mayfield Village Civic Center Conference Room. Chairman Bill Marquardt presided.     

ROLL CALL

Present: Mr. Bill Marquardt (Chairman), Mrs. Mary Ann Wervey, Mr. Paul Fikaris, Mr. David Hunter, and Mr. John Marrelli

Also Present: Mr. Tom Cappello (Village Engineer (5:05 pm)) and Ms. Deborah Garbo (Secretary)

Absent: Mayor Bodnar, Mr. Mark Guidetti (Law Department), and Dr. Stephan Parker

CONSIDERATION OF MEETING MINUTES: Sept 13, 2016

Mr. Fikaris, seconded by Mr. Marrelli made a motion to approve the minutes of Sept 13, 2016.

Motion Carried. Minutes Approved As Written.

PROPOSALS:

OPEN PORTION:

Chairman Marquardt called the meeting to order beginning with the first item on the agenda.

Comprehensive Storm Water Management

Erosion & sediment Control

Mr. Marrelli states, Tom is stuck in traffic. This is the final version. It’s gone through the Law Department, language got cleaned up and no more changes.

DECISION:

  • Chapter 1128

Mr. Marrelli, seconded by Mrs. Wervey made a motion to adopt Chapter 1128 Comprehensive Storm Water Management as revised.

Chairman Marquardt asked, any discussion?

Mr. Hunter asked, I assume this final version is what we talked about at the last meeting?

Mr. Marrelli replied, yes. It’s now all corrected if you will.

Motion Carried. Recommendation to Council.

Mr. Marrelli, seconded by Mr. Fikaris made a motion to adopt Chapter 1129 Erosion & Sediment Control as revised.

Chairman Marquardt asked, any discussion?

There was none.

Section 1185.14 (d)
Political Signs

Mr. Marrelli states, we can’t act on this yet. We’re going to adopt our enforcement procedures to reflect the same enforcement that we settled on last year when we found out that there were court cases pending. So there won’t be any confiscations, there won’t be fines. We’re just going to try and get through this Election season.

Chairman Marquardt commented, the signs won’t be the issue this Election.

  • Mr. Cappello arrived @ 5:05 pm

Mr. Marrelli said, Tom we made a motion to adopt Chapters 1128 & 1129 as revised.

Mr. Cappello asked, are there any questions? I need to get three reads from Council and get it passed this year.

Mr. Marrelli updated Tom on political signs. There’s a court case pending in Garfield Heights that’s being appealed. Our Law Department is reluctant to pass anything new until this court case gets settled. For this year, we’ll keep things off of public property and onto private property. Anything on the freeways, corner of City Hall or anything like that, we’ll pick up. No fees will be charged. No fines will be levied.

NEXT STEP

Review Political Signs; Section 1185.14 (d) following court ruling of pending Garfield Heights case from the 6th Circuit Court of Appeals.
