Ordinance Review - April 14th 2015

The Ordinance Review Committee met in regular session on Tues, April 14, 2015 at 5:00 p.m. at the Mayfield Village Civic Center Conference Room. Chairman Bill Marquardt presided.

Mr. Marrelli, seconded by Mr. Catalano made a motion to approve the minutes of Sept 9, 2014..

Motion Carried. Minutes Approved as Written.

Election of Chairman

Chairman Marquardt opened the floor to a motion for Chairman of the Ordinance Review Committee 2015 nominations.

Mr. Catalano, seconded by Mr. Marrelli made the motion to nominate Bill Marquardt. 

Chairman Marquardt asked if there was any discussion. There was none. The nominations were closed.

Chairman Marquardt asked for a Roll Call on the nomination.  


Ayes: All                               
Nays: None                          

Motion Carried. Bill Marquardt to serve as 2015 Chairman.


Mr. Marrelli explained Chapter 138 never existed before. Chapter 137 used to say Building Commissioner / Service Director. One person with two titles. It went on to say what the duties were, it was combined Service work & Building Dept work. We had the Law Dept break it up and make 137 Department of Public Service and create a Chapter 138 called Building Department.

Jim Farmer arrived 5:04 p.m.

Mr. Marrelli continued, the Law Dept took some of the language out of my job description and wrote it out in general speech under (b) 1 – 6. 

What started this was when the Plans Examiner recently retired, I went into the book to see if he was an employee or part of the department’s makeup. One thing led to another and I realized we never split up the two departments. If I’m not mistaken, I think Bernie was the first Building Commissioner that wasn’t the Service Director back in the late 80’s.

Now we have a Chapter that covers the Building Department. The Charter covers compensation. This Chapter 138 covers duties. We have a full blown Job Description for all the positions in the Department, but we didn’t put that description in this Ordinance because it would get pretty wordy.

Chairman Marquardt asked, were there any changes in the wording?

Mr. Marrelli replied, no changes. The Law Department added (4) & (5) which basically come out of my job description:

(4) To be responsible for the care, inspection and maintenance of the structural integrity of the Civic Center and other Municipal buildings.

(5) To attend meetings of the Planning & Zoning Commission, Board of Appeals, Architectural Review Board and other committees upon request by the respective chair.

Mr. Marrelli states, number six is a catch all:

(6) To perform other duties as may be necessary to carry out the responsibilities of the position as required by the ordinances of the Municipality or orders of the Mayor.

Chairman Marquardt said this looks more like housekeeping than anything else.


Mr. Farmer, seconded by Mr. Catalano made a motion to accept revised Chapter 137 Department of Public Service and new Chapter 138 Building Department.  

Chairman Marquardt asked if any other discussion. There was none.

Nays: None                                                  

Motion Carried. Recommendation to Council.
