Committee Meeting Minutes
September 8, 2015
The Drainage & Infrastructure Committee met Tuesday, September 8, 2015 at 6:49 p.m. at the Mayfield Village Civic Hall.
Present: Tom Cappello (Engineer), Steve Jerome (Council Representative), Tom Marrie (Council Representative), Doug Metzung (Service Director), Joe Saponaro (Council Representative), and Susan Jerome (Committee Secretary)
Absent: Jerry Catalano (Resident Representative)
Also in Attendance: Mr. & Mrs. Harris and Rose Kubicek
Mr. & Mrs. Fairchild 6786 Seneca
The committee reviewed the proposal from Anselmo, Inc. to install a catch basin in the backyard to the existing drainage ditch alongside the house.
Motion to approve expenditure in the amount of $1,560.00 for 6786 Seneca.
Motion Carried. Expenditure Approved.
Mr. & Mrs. Harris 6897 Wildwood Trail
The committee reviewed the application submitted by Mrs. Harris. Councilman Jerome asked her if she would like to add any additional comments.
Mrs. Harris explained that upon purchasing the property, she spoke with the neighbors to see if they were affected by the swale that was filled in with dirt in the back of her property.
Councilman Saponaro asked Mrs. Harris if she purchased the property from the bank. She said from a sheriff’s sale.
Councilman Joe Saponaro said there was, most-likely, no buyers insurance to cover something like this.
Mrs. Harris said, no.
Mrs. Harris continued to explain that the previous owner’s son built a pond in the backyard. They assume he took the dirt from the pond and moved it into the swale. In addition to filling the swale, he mounded the dirt and planted trees at the site. The water has nowhere to go so floods the basement and has killed the trees. She also mentioned that her neighbor, Rose Kubicek, also has flooding.
Councilman Joe Saponaro asked who was the previous owner?
Mrs. Harris said Mike Farinacci.
Rose Kubicek said that she had submitted a D&I request regarding this but doesn’t remember the year. She also sent a letter in 2004 but didn’t receive a response from the Village.
Mr. Saponaro asked if there hasn’t been a problem then since 2004?
Rose said, yes, there has been. She talked to Mr. Farinacci about the problem, filling in the swale had created, and he would just “wave her off”. She also mentioned that this was affecting the DiFranco property but it was just a small area in the corner of their backyard.
Tom Cappello asked if Rose had a swale in her yard.
Rose said she does and it was also filled in. She said Mr. DiFranco said Mr. Farinacci put a pipe in the swale with a cap on it.
Mr. Saponaro asked if Mrs. Harris received estimates for the work?
Mrs. Harris said she received quotes to excavate the swale only and one with excavating the swale in addition to filling in the pond and removing the stones around the pond.
Mr. Marrie asked Doug if he had seen the property?
Mr. Metzung replied, yes.
Mr. Saponaro explained that the Village is shaped like a bowl and the purpose of this committee is to help the property owners who are affected by natural causes. The problem with the swale on your property if due to the previous owner. The Village can guide you to a contractor who can assist you.
Mrs. Harris said Rose had contacted the Village in 2004 and no one responded.
Mr. Saponaro said to take pictures of the swale and pond and submit them to the committee. Also, have the affected homeowners sign the release form that came with the application. The committee rates projects based on several aspects. One of them being the number of affected properties.
Mr. Jerome said, once we have all the information, we will address it again at the next meeting.
The next meeting was scheduled for October 5, 2015 at 6:00 p.m. in Civic Hall.
There being no further matters, the meeting adjourned at 7:08 p.m.
