The Planning and Zoning Commission met in regular session on Mon June 3, 2013 at 7:35 p.m. at the Mayfield Village Civic Center, Civic Hall. Chairman Farmer presided.

ROLL CALL

Present:

Mr. Jim Farmer (Chairman), Mr. Garry Regan (Chairman Pro Tem), Mr. Paul Fikaris, Mr. Vetus Syracuse

Also Present:

Ms. Diane Calta (Law Department), Mr. Ted Esborn (Economic Development Director), Ms. Deborah Garbo (Secretary)

Absent:

Mr. Bill Marquardt, Dr. Sue McGrath, Mayor Rinker, Mr. Nick Delguyd (Council Alternate), Mr. Tom Cappello (Village Enginee), Mr. David Hartt (Planning Director), Mr. John Marrelli (Building Commissioner)

Consideration of Meeting Minutes:  April 1, 2013

Mr. Fikaris, seconded by Mr. Syracuse made a motion to approve the minutes of April 1, 2013.

Nays: None                                         

Motion Carried. Minutes Approved as written.

PROPOSAL:

  1. Riparian Setbacks
    New Ordinance Chapter 1127

 

OPEN PORTION:

Chairman Farmer called the meeting to order. This is a regular voting meeting of the Planning & Zoning Commission. We have one item on the agenda. We discussed this item at our workshop. There were some changes, i.e. giving authority to BZA as opposed to P & Z for the variances & appeals process.

Ms. Calta advised P & Z can vote tonight. It’s on the Caucus agenda tonight for discussion, not a vote. Council will be advised of your discussion tonight. I’ll let them know. By Charter this is one of those ordinances that had to go through Planning. It also went through Ordinance Review Committee.

DECISION:

Mr. Regan, seconded by Mr. Syracuse made a motion to approve Riparian Setbacks Ordinance as approved by the Ordinance Review Committee on May 14, 2013 with recommendation to Council for adoption. 

Chairman Farmer asked if any discussion.

Ms. Calta said there was one change from the Ordinance Review meeting. It was changing Planning and Zoning Commission to Board of Zoning Appeals.  

Mr. Syracuse noted the other was to add disclaimer language in 1127.05.

Ms. Calta added for the record since Tom isn’t here tonight; this is something that is part of the Phase II Requirements that the Village is required to adopt. There’s a map that P & Z saw that was put together by Tom identifying the areas that will have the setbacks. There is a process for variances and exceptions to be granted in circumstances as they arise.

Mr. Fikaris asked for clarification on a Conditional Use Permit request.

Chairman Farmer clarified Board of Zoning Appeals would grant the variance. Planning & Zoning would vote on a Conditional Use Permit request.

Nays: Mr. Regan                                 

Motion Denied.

Ms. Calta said you have a quorum, but you need four affirmative votes to recommend it to Council. Garry, you’ve voted against it, if you’d like, you can make a motion to reconsider.

MOTION TO RECONSIDER DECISION:

Mr. Regan, seconded by Mr. Syracuse made a motion to reconsider recommendation of Riparian Setbacks Ordinance to Council.

Ayes: Mr. Farmer, Mr. Regan “Mr. Regan states, noting my prior objections, and noting as well thatthis is merely a recommendation to Council, I will vote yes”, Mr. Fikaris, Mr. Syracuse
Nays: None

Motion Carried. Recommendation to Council.

Mr. Regan, seconded by Mr. Syracuse made a motion to adjourn the meeting.
