The Planning and Zoning Commission met in regular session on Mon April 1, 2013 at 7:00 p.m. at the Mayfield Village Civic Center, Civic Hall. Chairman Farmer presided.

Consideration of Meeting Minutes: March 4, 2013

Mr. Fikaris, seconded by Mr. Syracuse made a motion to approve the minutes of March 4, 2013.

Conditional Use Permit

Chairman Farmer called the meeting to order beginning with the conditional use permit for Crooked River CrossFit. I don’t think we were waiting for any updates other than we wanted to clarify the hours of operation. From the workshop you stated you were looking for 6:00 am to 8:00 pm weekdays & Sat 9:00 am to 12:00 noon. We think those hours are reasonable but we also don’t want you to cut yourself short.

Kyle Eshleman, owner Crooked River CrossFit confirmed hours as stated by Chairman. We should be fine with that.

Chairman Farmer asked Kyle to clarify if the 8:00 pm class starts at 8:00 or ends at 8:00.

Kyle Eshleman stated we’re usually done by 8:00 pm.

Chairman Farmer asked if anyone has any questions or comments. There were none.

DECISION

Mr. Syracuse, seconded by Mr. Regan made a motion to approve the Conditional Use Permit for Crooked River CrossFit at 701 Beta Dr. Unit 19 as discussed with the condition as noted:

  1. Maximum hours of operation permitted under permit will be Mon through Fri 6:00 am to 8:00 pm and Sat 9:00 am to 12:00 noon.

 

Chairman Farmer asked Kyle about signage.

Kyle Eshleman stated we have window & door decals. Lakeshore Gymnastics has a yard sign at the driveway when you pull in. We’ll have something like that, something that points that CrossFit is this way. Being set far back, it’s hard to see any signage from the windows. I talked to John about it and he said it shouldn’t be an issue.

Mr. Fikaris asked if there’s a monument sign.

Kyle Eshleman replied there is. It’s set back, kind of a small one. We just wanted something closer up by the road.

Ms. Calta stated tonight is just for the conditional use. If there are any questions on the signage, you’ll have to work with John. If he feels there’s another approval necessary or a variance, he’ll have to bring you either back here or to the Board of Appeals.

Mr. Marrelli & Mr. Cappello arrive @ 7:15 p.m.

Chairman Farmer moves on to the next agenda item, a conditional use permit for Koinonia Homes. We discussed this at the workshop. We discussed hours of operation presented as 8:00 am to 5:00 pm. There was discussion regarding a fire evacuation alarm system because of the number of occupants in the program/building. Mike, have you had discussion with the owners?

Lt. Michael Girbino said yes, I communicated with them. I was on the site today. I also had dialogue with Ms. Calta. We discussed the nature of this issue and whether or not that would be within the Boards scope to enforce something that’s within the fire or building code. We collectively believe it would best be left outside of your scope. I met with the representatives from Geis today and they’re willing to voluntarily make a move to update the fire protection in that building over time.

Brandon Kline from Geis Companies said we’re looking at right now the financial feasibility of being able to do that and the undertaking of that being the fact of the buildings age. We’re taking a look to see how we can accommodate the request and recommendations for future growth. As we get this building more tenanted, more filled we’ll take a look and address the building as a whole at that time.

Chairman Farmer said we just have the matter of the hours then; 8:00 am to 5:00 pm.

Brandon Kline said that’s correct. My question to the Board would be, are you suggesting a restriction on hours for operation?

Chairman Farmer said yes. That would be a condition of the permit.

Brandon Kline stated 8:00 to 5:00 would be normal business hours for them. My only concern is that I could very easily see them needing to take a shipment from a truck in shipping/receiving either before or after that time in a unique situation. I hate to see something limit them from being able to do that when most shipments come in before 8:00 am.

Chairman Farmer clarified the condition would not limit that. It was more the number of occupants at one time and Police purposes. They would want to know when they’ll have 100 people in that building. I don’t think receiving shipment was really a concern.

Brandon Kline stated as far as business hours, 8:00 am to 5:00 pm would be more than sufficient. The paid Interns don’t come in until 9:00 to 4:00. Their maybe 10 employees may come in from 8:00 to 5:00. Shipping and receiving time period is where they’ll need the flexibility.  

Chairman Farmer asked if anyone has any questions or comments. There were none.

DECISION

Mr. Fikaris, seconded by Mr. Regan made a motion to approve the Conditional Use Permit for Koinonia Homes at 701 Beta Dr. Unit 5 as discussed with the conditions as noted:

  1. Hours of operation permitted under permit will be Mon through Fri 8:00 am to 5:00 pm with occupancy. Occupancy stated at approximately 20 employees and 75 paid Interns maximum.
  2. Fire Evacuation issues to be addressed in the future.

Chairman Farmer stated it sounds like we’ll have a workshop later this month, so plan on it April 18th.

Mr. Marquardt asked if we’ll have our conditional use / special use guidelines by then.

Ted Esborn replied they’re coming. We’re working on it.
